VALUE FENCING®
LIMITED PRODUCT, UV AND WORKMANSHIP WARRANTY
This Warranty must be read together with the applicable Estimate / Quotation, Tax Invoice, Final Invoice, Terms and Conditions of Sale, maintenance instructions and any product-specific written scope issued by the contracting Value Fencing® entity.
This Warranty contains important provisions regarding:
• the identity of the warrantor
• warranty eligibility and proof requirements
• product and colour warranty limitations
• exclusions and limitations
• franchisor non-liability
• warranty continuity within the Value Fencing® franchise network
• protection of Value Fencing® customer relationships.
By accepting supply, delivery or installation of Value Fencing® products, the Customer acknowledges and accepts this Warranty.
PRODUCT WARRANTY
(PVC Profiles & Material Defects Only)
- PRODUCT WARRANTY STRUCTURE
1.1 This Product Warranty applies solely to approved PVC extrusion profiles and related PVC materials supplied through the approved Value Fencing® supply network and/or approved manufacturers.
1.2 PVC profiles manufactured and supplied by approved manufacturers, including DM Plastics, are covered by the applicable Limited Lifetime Material Warranty offered by the approved manufacturer, subject to:
• correct installation,
• normal residential use,
• compliance with prescribed installation specifications,
• environmental conditions,
• and the manufacturer's applicable warranty terms and exclusions.
1.3 This Product Warranty covers manufacturing defects in the PVC material itself, including:
• abnormal cracking,
• blistering,
• peeling,
• excessive delamination,
• or structural failure resulting directly from proven manufacturing defects under normal intended use.
1.4 This Product Warranty does not cover:
• improper installation,
• incorrect handling,
• abuse,
• vandalism,
• accidental damage,
• storm or force majeure damage,
• structural movement,
• misuse,
• impact damage,
• fire damage,
• chemical exposure,
• unauthorised alterations,
• paint coatings,
• or failures caused by non-approved accessories or installation methods.
1.5 Colour variation, weathering, normal fading, expansion, contraction, or slight dimensional tolerances within accepted industry standards shall not constitute a material defect.
1.6 This Product Warranty excludes all third-party or ancillary products including, but not limited to:
• ironmongery,
• locks,
• hinges,
• wheels,
• bearings,
• motors,
• automation systems,
• brackets,
• fasteners,
• screws,
• steel,
• aluminium,
• rebar,
• epoxy,
• concrete,
• sealants,
• electrical components,
• or any non-PVC accessory or hardware component.
Such products remain subject solely to the warranties, if any, provided by their respective manufacturers or suppliers.
1.7 The Value Fencing® franchisor is not the manufacturer of PVC profiles unless expressly stated otherwise in writing and acts primarily as franchisor and network administrator.
1.8 Any approved remedy under this Product Warranty shall, at the discretion of the approved manufacturer and/or applicable supplier, be limited to:
• repair,
• replacement,
• or supply of equivalent replacement material.
No liability shall arise for:
• consequential damages,
• indirect losses,
• loss of profits,
• project delays,
• labour costs,
• transport costs,
• or third-party contractor costs unless otherwise required by applicable law.
1.9 Nothing contained herein is intended to limit or exclude any consumer rights afforded under the Consumer Protection Act 68 of 2008 to the extent such rights may not lawfully be limited or excluded.
INSTALLATION & WORKMANSHIP WARRANTY
(Labour, Installation & Franchise Workmanship Only)
- INSTALLATION WARRANTY STRUCTURE
1.1 Each authorised Value Fencing® franchisee operates as an independent business entity and remains solely responsible for:
• its own installations,
• workmanship,
• labour,
• staff,
• subcontractors,
• project execution,
• and workmanship warranty obligations relating to installations performed by that franchisee.
1.2 The specific franchisee identified as the supplier and installer on the applicable Estimate, Quotation, Tax Invoice, or Installation Agreement ("the Contracting Franchisee") shall be solely responsible for workmanship and installation warranty obligations arising from that installation.
1.3 Unless expressly recorded otherwise in writing, the Value Fencing® franchisor is not the installer, contractor, subcontractor, or warrantor in respect of installation workmanship performed by independent franchisees.
1.4 The franchisor may, at its discretion and as an administrative facilitation service, assist customers and franchisees with the coordination and administration of warranty claims within the franchise network. Such facilitation shall not constitute acceptance of legal liability by the franchisor for the acts, omissions, workmanship, or contractual obligations of any independent franchisee.
1.5 The Installation & Workmanship Warranty applies only to defects arising directly from proven poor workmanship or improper installation performed by the Contracting Franchisee.
1.6 This Warranty does not cover:
• normal wear and tear,
• structural movement,
• ground settlement,
• subsidence,
• misuse,
• abuse,
• accidental damage,
• vandalism,
• storm damage,
• force majeure,
• customer-supplied materials,
• unauthorised modifications,
• poor maintenance,
• corrosion of non-PVC components,
• or failures caused by third-party contractors or non-approved installers.
1.7 Certain installations may incorporate third-party or externally sourced components including, but not limited to:
• ironmongery,
• locks,
• hinges,
• wheels,
• bearings,
• motors,
• automation systems,
• brackets,
• screws,
• fasteners,
• rebar,
• epoxy,
• steel,
• aluminium,
• concrete,
• sealants,
• or electrical components.
The Contracting Franchisee remains responsible for correct installation thereof, but no warranty is provided by the franchisor regarding the manufacturing quality or lifespan of such third-party products unless expressly stated otherwise in writing.
1.8 Where a franchisee has exited, sold, terminated, resigned from, or ceased operating within the Value Fencing® franchise network, the franchisor may, at its sole discretion:
• assist in facilitating communication regarding historic warranty claims,
• appoint another approved installer to inspect or repair work,
• or provide administrative assistance to the customer.
However, unless otherwise required by applicable law, the franchisor shall not automatically assume liability for:
• workmanship defects,
• installation failures,
• third-party hardware failures,
• or contractual obligations originally undertaken by the former franchisee.
1.9 Customers acknowledge that all franchisees operate independently and that workmanship responsibility primarily rests with the original Contracting Franchisee responsible for the installation.
1.10 Nothing contained herein is intended to limit or exclude any consumer rights afforded under the Consumer Protection Act 68 of 2008 to the extent such rights may not lawfully be limited or excluded.
2. CONSUMER PROTECTION ACT PRESERVATION
2.1 Nothing in this Warranty is intended to exclude, limit or waive any right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008.
2.2 This Warranty operates in addition to any statutory rights the consumer may have.
3. WARRANTY ELIGIBILITY AND PROOF OF PURCHASE
3.1 This Warranty applies only to the original purchaser named on the Value Fencing® Tax Invoice.
3.2 The Customer must produce the original Value Fencing® Tax Invoice when submitting a warranty claim.
3.3 Failure to provide the Tax Invoice may result in the claim being declined.
3.4 This Warranty applies only for the lifetime of the original owner at the original installation address.
3.5 Where installations form part of:
• sectional title schemes
• body corporate property
• estates
• complexes
• commercial developments
• communal ownership structures
the warranty period shall be 20 (twenty) years from invoice date, regardless of change in individual ownership.
3.6 Except where required by law, this Warranty is non-transferable.
4. LIMITED LIFETIME PRODUCT WARRANTY - STANDARD WHITE PVC
4.1 Subject to the terms and exclusions of this Warranty, the Contracting Company warrants that standard white PVC / uPVC material components supplied by the Contracting Company will remain free from manufacturing defects causing:
• peeling
• cracking
• chipping
• blistering
during the service life of the product for the lifetime of the original owner, with a minimum warranty period of 20 (twenty) years from invoice date.
4.2 For purposes of this Warranty, standard white PVC material means the factory white PVC supplied as the standard Value Fencing® colour.
4.3 This warranty applies only to the PVC material substrate itself.
4.4 It does not extend to:
• hardware
• accessories
• structural supports
• third-party additions.
4.5 The warranty applies only where the product has been:
• supplied by the Contracting Company
• properly installed
• used for its intended purpose
• reasonably maintained.
5. COLOUR AND UV PROTECTION WARRANTY
5.1 Standard White PVC
Standard white PVC material is covered by the same warranty period as the product material warranty described in Clause 4.
5.2 Alternate Colours and Custom Colours
Any non-standard colour, including:
• custom colour matches
• coated finishes
• painted finishes
• special-order colours
• alternate standard colours such as Anthracite
shall be covered against material discoloration caused solely by normal sunlight exposure for a period of 5 (five) years from invoice date only.
5.3 The colour warranty applies only to the colour stability of the supplied material and does not extend to:
• colour variation within manufacturing tolerances
• fading from abnormal environmental conditions
• heat distortion from darker colours
• repainting by third parties
• incorrect surface preparation
• incompatible coatings.
5.4 The colour warranty does not cover discoloration caused by:
• air pollution
• industrial fallout
• harmful chemicals
• corrosive substances
• unsuitable cleaning products
• misuse or neglect.
6. CLEANING AND MAINTENANCE
6.1 PVC products must be cleaned only using non-abrasive cleaning products suitable for PVC materials.
6.2 Recommended cleaning products include:
• Domestos
• Kleen Green
• P-11
• or other suitable non-abrasive cleaners.
6.3 Abrasive cleaners, solvents, petroleum-based cleaners, acids or alkalis may cause damage and are not recommended.
6.4 Damage caused by unsuitable cleaning methods is excluded.
7. PAINTING AND COATING CONDITIONS
7.1 Painting of standard white PVC using acrylic roof paint after light sanding and proper preparation does not void the underlying PVC material warranty.
7.2 Paint finishes applied by the Customer or third parties are not covered by this Warranty.
7.3 Damage caused by:
• unsuitable primers
• incompatible coatings
• incorrect preparation
• dark heat-intensive colours
• incorrect painting methods
is excluded.
7.4 Where products are supplied in non-standard colours, the applicable colour warranty remains limited to 5 years as described in Clause 5.
8. INSTALLATION AND WORKMANSHIP WARRANTY
8.1 The Contracting Company provides a 12-month workmanship warranty.
8.2 This covers defects attributable to installation performed by the Contracting Company.
8.3 This warranty does not cover:
• structural movement
• storm damage
• misuse
• third-party modifications.
9. NON-PVC COMPONENTS
The following components are excluded:
• hinges
• latches
• rollers
• brackets
• motors
• automation systems
• electric fencing
• electronic access systems
• sheeting or coverings.
These may carry separate manufacturer warranties.
10. STRUCTURAL EXCLUSIONS
This Warranty does not cover failures caused by:
• hollow block walls
• single-row brick walls
• precast walls
• retainer blocks
• defective foundations
• poor concrete
• soil movement
• structural wall movement.
11. THIRD-PARTY MODIFICATIONS
Damage caused by modifications or additions by third parties is excluded.
This includes:
• roofing
• sheeting
• electrical additions
• attachments or alterations.
12. WARRANTY CLAIM PROCESS
12.1 Claims must be submitted in writing.
12.2 The Customer must provide:
• original Value Fencing® Tax Invoice
• installation address
• description of defect
• photographs if available.
12.3 The Contracting Company may inspect the product by:
• site inspection
• remote inspection
• inspection of returned components.
12.4 If the claim is valid, the Contracting Company may:
• repair
• replace
• rectify installation.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Contracting Company shall not be liable for:
• indirect damages
• consequential loss
• business interruption
• inconvenience.
Where liability cannot be excluded, it shall be limited to the value of the defective goods or services.
14. FRANCHISOR NON-LIABILITY
Unless the franchisor is expressly named as the contracting party, the franchisor is not responsible for warranty obligations arising from installations performed by franchisees.
Each franchisee warrants only the work performed by that franchisee.
15. WARRANTY CONTINUITY
If the original franchisee:
• ceases trading
• becomes insolvent
• leaves the network
• is terminated
• rebrands
the franchisor may appoint another authorised franchisee to administer warranty obligations.
The franchisor may assist but is not obliged to assume the original franchisee's liability.
16. FORMER OR UNAUTHORISED FRANCHISEES
Former franchisees may not:
• administer Value Fencing® warranties
• represent themselves as authorised
• divert existing warranty relationships.
17. CLIENT NON-SOLICITATION PROTECTION
Where a Value Fencing® installation originated through the authorised franchise network, the warranty relationship remains within the network.
Former franchisees may not assume warranty obligations by misrepresenting affiliation.
18. ENTIRE WARRANTY
This document together with the Terms of Sale, Quotation and Invoice constitutes the entire Warranty agreement.
No verbal statement shall vary this Warranty.
19. NETWORK CLIENT PROTECTION AND WARRANTY ADMINISTRATION RIGHTS
19.1 Value Fencing® operates as a franchise network consisting of independently owned and operated franchise businesses licensed to trade under the Value Fencing® brand.
19.2 Where the Customer originally purchased Value Fencing® products or services through an authorised franchisee, the Customer relationship, product support, warranty administration and after-sales service form part of the Value Fencing® franchise network system.
19.3 In the event that a franchisee:
• ceases trading
• sells its business
• loses its franchise licence
• is terminated from the franchise network
• rebrands under another name
• becomes insolvent
• or is otherwise no longer authorised
the franchisor reserves the right to reassign the Customer relationship and warranty administration to another authorised Value Fencing® franchisee or approved contractor.
19.4 This clause ensures:
• continuity of service
• preservation of product standards
• protection of warranty integrity
• stability of the franchise system.
19.5 Former franchisees may not:
• represent themselves as authorised Value Fencing® representatives
• administer Value Fencing® warranties
• solicit or divert existing Value Fencing® warranty relationships.
19.6 The franchisor may, but is not obliged to, facilitate warranty continuity where the original franchisee is no longer operational.
19.7 Any warranty service provided by another authorised franchisee shall be limited strictly to the original scope of this Warranty and the Terms of Sale.
